• Save favorite listings and professionals

3. User Accounts

3.1 Account Creation

To use certain features of Celmes, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

Celmes offers different account types including customer accounts and professional accounts. Each account type has different features and obligations as outlined in these terms.

4. Professional Services

4.1 Independent Contractors

All service providers on Celmes are independent contractors. Celmes does not employ service providers and is not responsible for their actions, services, or work quality. We simply provide a platform for connection.

4.2 Professional Responsibilities

Service providers must:

• Maintain any required licenses, certifications, and insurance
• Provide accurate information about their services and qualifications
• Deliver services in a professional and timely manner
• Comply with all applicable laws and regulations
• Handle customer data responsibly and in accordance with privacy laws

4.3 Verification

While we may offer verification badges, these do not constitute an endorsement or guarantee of quality, reliability, or competence. Users should conduct their own due diligence.

5. Property Listings

Users listing properties must:

• Have the legal right to list the property
• Provide accurate and complete information
• Include clear and truthful photos
• Comply with all applicable housing and discrimination laws
• Update or remove listings when they are no longer available

6. User Conduct

You agree not to:

• Use the platform for any illegal purpose or in violation of any laws
• Post false, misleading, or fraudulent information
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Attempt to circumvent our platform to avoid fees
• Scrape, copy, or use automated means to access our platform without permission
• Upload viruses or malicious code
• Interfere with the proper functioning of the platform

7. Payments and Fees

Celmes may charge fees for certain services including premium professional listings and featured property placements. All fees are clearly disclosed before you commit to any paid service.

Payment transactions between customers and service providers are handled directly between those parties. Celmes is not responsible for payment disputes or failed transactions outside of our payment processing system.

8. Content and Intellectual Property

8.1 User Content

You retain ownership of content you post on Celmes. However, by posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with operating and promoting the platform.

8.2 Platform Content

All content on Celmes, including text, graphics, logos, and software, is owned by Celmes or our licensors and is protected by copyright and other intellectual property laws. You may not use our content without permission.

9. Reviews and Ratings

Users may post reviews and ratings of service providers and properties. Reviews must be honest, accurate, and based on genuine experiences. We reserve the right to remove reviews that violate our policies, including fake reviews, reviews containing offensive content, or reviews that violate privacy.

10. Disclaimers and Limitations of Liability

10.1 Platform "As Is"

Celmes is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the platform's reliability, availability, or suitability for any purpose.

10.2 Third-Party Services

We are not responsible for the quality, safety, or legality of services provided by professionals on our platform, or the accuracy of property listings. Users engage with service providers and properties at their own risk.

10.3 Limitation of Liability

To the maximum extent permitted by law, Celmes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you paid to Celmes in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Celmes harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these terms, or your violation of any rights of another party.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may close your account at any time by contacting us. Upon termination, your right to use the platform immediately ceases.

13. Dispute Resolution

Any disputes arising from these terms or your use of Celmes shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.

You and Celmes agree to waive the right to a jury trial and to participate in class action lawsuits.
